Chapter 6: Individualized Education Program (IEP)

Implementing the Individual Educational Program (IEP)

Once the Pupil Evaluation Team (PET) has developed annual goals and objectives, and has addressed all the elements required, school personnel will be responsible for the actual writing of the Individual Educational Program (IEP). A complete copy of the IEP shall be provided to you within 21 school days of the PET meeting at which the IEP was developed. Be sure to compare the completed IEP with your notes to make sure that all the services discussed at the PET meeting are included.

The school is responsible for implementing the IEP as soon as possible following the PET meeting. If your child requires a variety of supportive services, the school may need to make arrangements with therapists or other qualified personnel to provide those services. Classroom teachers and other school personnel will need to be notified of any modifications, accommodations or specialized instruction necessary. The amount of time it takes to arrange all of this may vary, depending on the nature and complexity of the services identified for your child. However, the expectation is that the school must work to complete the arrangements as quickly as possible so that your child can begin working to achieve the goals and objectives identified in the IEP. The maximum amount of time allowed for the school to implement the IEP, according to Maine State Education Regulations (MSER), Chapter 101, is 30 days.

"Each school administrative unit shall implement a student's with a disability Individualized Education Program as soon as possible following the PET meeting but no later than 30 days after the PET’s initial identification of the student as a student with a disability in need of special education and supportive services. All identified students with disabilities shall have a current Individualized Education Program in effect at the start of each school year." (MSER, Chapter 101, Section 10.5, p. 55)
