Chapter 7: When Things Aren't Going Well

Superintendent Complaint

A Superintendent Complaint is filed at the local level. The superintendent will appoint a third party to conduct the investigation and make a recommendation within 10 days after receiving the complaint in writing.

Process needs to be completed within 30 days from receipt of the written request.

"You have the right to file a written complaint with the superintendent of the administrative unit responsible for the education of your son or daughter if you have reason to believe that the administrative unit is not in compliance with these special education regulations. The superintendent, or a designee, shall then appoint a person to investigate your complaint and to recommend to the superintendent, within 30 days of the receipt of the written complaint, any corrective action necessary to resolve your complaint." (MSER, Chapter 101, Section 12.11G, p. 71)

remember It is critical that all communications be in written form. Be sure to keep copies of everything both sent and received for your own records.
