Chapter 8: Behavior and Discipline

Students Who Are Not Yet Eligible for Special Education

A student may assert any of the protections that a student identified with disabilities has if:

  • The school had prior knowledge of the need for special education.
  • The parent expressed concerns to the school in writing.
  • Students behavior or performance demonstrated the need.
  • Parent had requested an evaluation.
  • Teachers or other school personnel had expressed concern to the Special Education Director or other administrator, (Maine State Education Regulations (MSER), Chapter 101, Section 14.10, p. 96.)

 

What Has Worked For Me As A Parent Dealing With Behavior and Discipline...

"My son always needed quiet spaces, structure, predictable routines, small group settings, and teachers who saw him as a kid with strengths and limitations. When he went to Junior High, none of the things he needed existed. He got more discipline slips in 6 weeks of school than in the previous 6 years. I knew it was going to be difficult but I wasn't prepared for how difficult.

What worked for me was:

  • Everyday from the first day of school I kept a log of issues, calls, meetings, how he was doing.
  • I talked with people who know about programs, placements and laws.
  • I read the laws related to discipline.
  • I visited other options.
  • I had a good working relationship with the Special Education Director.
  • I asked for help.
  • I walked around the block with a friend.
  • I fell apart and regrouped over and over."
